By indicating your acceptance, you understand, agree, warrant and covenant as follows:
Waiver: In consideration of the acceptance of this entry in said event, May 2, 2020, at Drake Well Museum and Park and Oil Creek State Park, we, the undersigned participant and (if participant is under 18 yrs of age) parent or guardian, intending to be legally bound, do hereby for ourselves, our heirs, executors and administrators, waive, release and forever discharge any and all rights or claims for damages which we, or either of us, may have or which hereafter accrue to us, or either of us, against any and all persons, organizations and legal entities affiliated with such an event, and more particularly, Friends of Drake Well, Inc., Drake Well Museum and Park, PHMC, Oil Creek State Park, DCNR, Commonwealth of Pennsylvania, Miles of Smiles timing service, together with their representative officers, agents, representatives, employees, successors, assign and/or sponsors, for any and all damages which may be sustained or suffered by us in connection with or entry in, and/or arising out of our travel to, participation in and returning from said event. I/we hereby agree to release to the event promoter full and exclusive rights to record my performance on film, videotape, or still photography for use without compensation. I/we understand that this is an arduous athletic event and hereby certify that I/we have trained and properly conditioned to participate. In case of a weather related cancellation, I understand that my entry fee will be forfeited, but I will still be entitled to my race bag and finisher award.
